第1条（本規約の適用） / Article 1: Application of These Terms

本規約は、surugawan studio（以下「当スタジオ」）が提供するスマートフォン向けゲームアプリ「Flame of Lifespan」（以下「本アプリ」）の利用に関する一切の関係に適用されます。ユーザーは、本アプリをダウンロード、インストール、または利用した時点で、本規約に同意したものとみなされます。

These Terms of Service (“Terms”) apply to all use of the mobile game app “Flame of Lifespan” (the “App”) provided by surugawan studio. By downloading, installing, or using the App, users are deemed to have agreed to these Terms.
第2条（利用環境および自己責任） / Article 2: Usage Environment and User Responsibility

ユーザーは、本アプリの利用に必要な端末、通信環境、OS、アカウント等を自己の責任と費用において準備し、維持するものとします。通信料その他の費用はユーザーの負担とします。

Users are responsible for preparing and maintaining their own device, network connection, operating environment, and any required accounts at their own expense. Communication fees and any related costs are borne by the user.
第3条（データおよびアカウント） / Article 3: Data and Accounts

- 本アプリでは、プレイデータ、設定情報、端末識別情報その他の利用情報を、サービス提供または不具合対応のために取り扱う場合があります。
- データの保存、復元、引き継ぎ、同期の可否および範囲は、本アプリの仕様、配信プラットフォーム、またはその時点の運用方針に従います。
- 当スタジオは、データ消失、破損、改ざん、端末故障、通信障害その他ユーザーの環境に起因する損害について、当スタジオに故意または重過失がある場合を除き責任を負いません。

- The App may process gameplay data, settings, device identifiers, and other usage information for service operation or issue resolution.
- The availability and scope of data saving, restoration, transfer, and synchronization depend on the App’s specifications, distribution platform, and operational policy at the relevant time.
- Except in cases of willful misconduct or gross negligence by us, we are not liable for damages caused by data loss, corruption, device failure, communication errors, or other issues arising from the user’s environment.
第4条（禁止事項） / Article 4: Prohibited Actions

- 法令または公序良俗に反する行為
- 当スタジオまたは第三者の権利、利益、名誉、信用を侵害する行為
- 本アプリの不具合、仕様、通信、認証、データ構造等を不正に利用する行為
- 不正アクセス、チート行為、ボット利用、改造、リバースエンジニアリング、解析
- 本アプリまたは関連サーバーに過度な負荷を与える行為
- 本アプリの運営を妨害し、または妨害するおそれのある行為
- その他、当スタジオが不適切と判断する行為

- Violating laws or public order and morals
- Infringing the rights, interests, reputation, or credit of us or third parties
- Improperly exploiting bugs, specifications, communications, authentication, or data structures of the App
- Unauthorized access, cheating, bot use, modification, reverse engineering, or analysis
- Imposing excessive load on the App or related servers
- Interfering with the operation of the App or attempting to do so
- Any other conduct deemed inappropriate by us
第5条（知的財産権） / Article 5: Intellectual Property

本アプリ、本アプリに含まれる文章、画像、音声、プログラム、デザインその他一切の権利は、当スタジオまたは正当な権利者に帰属します。法令上認められる場合を除き、無断で複製、転載、配布、改変、公衆送信等を行うことはできません。

All rights relating to the App and all materials contained in it, including text, images, audio, software, and design, belong to us or the legitimate rights holders. Except as permitted by law, users may not reproduce, redistribute, modify, or publicly transmit such materials without authorization.
第6条（サービス内容の変更・停止・終了） / Article 6: Changes, Suspension, and Termination

当スタジオは、ユーザーへの事前通知なく、本アプリの内容を変更し、提供を一時停止し、または終了することがあります。これによりユーザーに損害が生じた場合でも、当スタジオに故意または重過失がある場合を除き責任を負いません。

We may change, suspend, or terminate the App without prior notice. Even if this causes damage to users, we are not liable except in cases of willful misconduct or gross negligence by us.
第7条（利用停止等） / Article 7: Restriction or Suspension of Use

当スタジオは、ユーザーが本規約に違反した場合、または本アプリの安全な運営に必要と判断した場合、事前通知なく、ユーザーによる本アプリの利用を制限または停止することがあります。

We may restrict or suspend a user’s access to the App without prior notice if the user violates these Terms or if we determine such action is necessary for safe operation of the App.
第8条（免責事項） / Article 8: Disclaimer

- 当スタジオは、本アプリが特定の目的に適合すること、期待される機能・商品的価値・正確性・有用性・継続性を有することを保証しません。
- 当スタジオは、本アプリに事実上または法律上の瑕疵がないことを保証しません。
- 当スタジオは、本アプリの利用または利用不能により生じた損害について、当スタジオに故意または重過失がある場合を除き責任を負いません。

- We do not guarantee that the App will fit any particular purpose or have expected functionality, commercial value, accuracy, usefulness, or continuity.
- We do not guarantee that the App is free from factual or legal defects.
- We are not liable for damages arising from the use or inability to use the App except in cases of willful misconduct or gross negligence by us.
第9条（準拠法および管轄） / Article 9: Governing Law and Jurisdiction

本規約は日本法に準拠し、本アプリまたは本規約に関連して生じる紛争については、静岡地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms are governed by the laws of Japan. Any dispute arising out of or in connection with the App or these Terms shall be submitted to the exclusive jurisdiction of the Shizuoka District Court as the court of first instance.
